These are the Terms and Conditions that apply to the use of the Fulbridge Social Care Website, the Terms and Conditions may be updated without notice to you. You should review these Terms and Conditions periodically for changes. Particular services provided on the Fulbridge Social Care Website may also be governed by additional or alternative Terms and Conditions, which will be posted on the Fulbridge Social Care Website. By using the Fulbridge Social Care Website you are deemed to have accepted these Terms and Conditions.
The Privacy Policy notice applicable to Jobseekers also applies to your use of the Fulbridge Social Care Website.

In these Terms and Conditions, the following words shall have the following meanings:
”Company” Means trading as Fulbridge Social Care Ltd
”Intellectual Property” Means copyright and other intellectual property rights whatsoever an wherever subsisting in the CV and candidate information
”Fulbridge Social Care website” Means the company website www.fulbridgesocialcare.co.uk
”Personal Data” Has the meaning as more particularly defined in the Data Protection Act 1998
”Profile Information” Means the information provided by a candidate including (without limitation) name, email address. location and current role
1. Use of material
1.1 You can download, print and copy material from the Fulbridge Social Care Website for your own personal use. You must not reproduce any part of the Fulbridge Social Care Website or any other materials owned by Fulbridge Social Care including emails, profiles, training certificates along with marketing, resourcing and advertising material unless the Company have granted you permission to do so.
2. Disclaimer of liability
2.1 To the extent permitted by law and subject to clause 10.1 the Company accepts no responsibility for the content of advertising material, including, (without limitation), any error, omission or inaccuracy there in.
2.2 To the extent permitted by law and subject to clause 10.1 the Company does not warrant that:

2.4 The Fulbridge Social Care Website or any of its contents are virus free; or
2.5 The provision of any of the services of the Company will be uninterrupted or error-free.
3. Accessing external websites
3.1 You can access other sites via links from the Fulbridge Social Care Website. These sites are not under the control of the Company, and the Company accepts no responsibility for any content on such sites or for any use to which they put any personal or confidential information provided by you.
4. Registering for a Fulbridge Social Care Website account
4.1 If you register for an account on the Fulbridge Social Care Website, you will be required to provide your:

Which we will store in order to create an individual user account for you. The Company is committed to ensuring your privacy is protected. This information will only ever be used by the Company. The Company will not contact you other than to send you, information about jobs, the bulletins you have subscribed to or internal news about the Company’s services for jobseekers, or offers from the Company’s partner companies and invitations from the Company to take part in research / surveys. The Company will not distribute any of the details including the email address you provide to a third party. The Company have put in place suitable security procedures to safeguard your information.
4.2 Access to your members account on the Fulbridge Social Care Website is via your:

Please keep your password safe and do not disclose it to anyone else.
4.3 Any registration details you use must be personal to you and must not be used by anyone else.
4.4 You must not maliciously create additional accounts on the Fulbridge Social Care Website.
4.5 If, for any reason, the Company believes that you have not complied with these terms and conditions, or are misusing your Fulbridge Social Care Website account in any way, the Company may, at its discretion, cancel, suspend or otherwise restrict your access to your Fulbridge Social Care website account immediately and without giving any advance notice.
5. Registration for Jobs by Email
5.1 The Company does not guarantee that the Jobs by Email service will be compatible with your email provider.
5.2 The Company can cancel access to the Jobs by Email service at any time if you do not comply with these Terms and Conditions.
6. Equal Opportunities
6.1 Fulbridge Social Care has a policy of Equal Opportunities and as such will consider applications from candidates irrespective of sex, race, colour, ethnic or national origin, disability or willingness to work extended hours.
7. Careers Advice
7.1 The views expressed and content of the Careers Advice section (the “Materials”) are primarily those of the respective authors and not necessarily those of the Company.
7.2 Although the Company has made every effort to ensure that the Materials are accurate at the time of publishing, it gives no warranties and makes no representations, express or limited, as to the accuracy, quality, validity or completeness of the Materials.
7.3 The Company shall be under no obligation to notify any person of any error in the Materials.
7.4 To the extent permitted by law and subject to clause 10.1 the Company and their respective staff accept no responsibility for any use which is made of the Materials and shall not be liable to any person for any direct or indirect loss or damage, including (without limitation) loss of profits, loss of revenue, loss of data or any third party claims which may arise from the use of the Materials.
8. Email Communications
8.1 Messages from the Company may be confidential. If you are not the intended recipient you should not copy or disclose any message to anyone but should kindly notify the sender and delete the message.
8.2 Opinions, conclusions and other information in any message that do not relate to the official business of the Company or the Fulbridge Social Care Website shall be understood as neither given nor endorsed by it.
8.3 The Company accepts no responsibility for viruses and it is the recipient’s responsibility to scan any email and any attachments.
8.4 The Company reserves the right to access and disclose all messages sent over its email system.
9. Problems with the Fulbridge Social Care Website
9.1 If you experience any problems with the Fulbridge Social Care Website or wish to make a complaint about the Fulbridge Social Care Website, any of the services available on the Fulbridge Social Care Website or any recruiters who you feel are misusing the services the Company provide then please contact us immediately.
9.2 To the extent permitted by law and subject to clause 10.1 the Company does not accept any liability for any delay or disruption that you may experience whilst using any aspect of the Fulbridge Social Care Website or for any loss or damage to your account or any loss or damage caused by any error or technical fault in respect of the transfer of a CV by you to the Fulbridge Social Care Website.
9.3 The Company do not guarantee the continued and uninterrupted availability of any aspect of the Fulbridge Social Care Website and to the extent permitted by law and subject to clause 10.1 the Company accepts no liability for any unavailability including without limitation due to technical errors or faults.
9.4 The Company is concerned for the privacy of visitors and registered users of the Fulbridge Social Care Website. The protection of your personal information is extremely important to us. However, please remember that the security of information transmitted over the Internet cannot be assured.
10. Liability
10.1. Nothing in these Terms and Conditions will exclude or limit the Company’s liability to you for fraud or statements made fraudulently; or for death or personal injury caused by the Company’s negligence, or for any other liability which cannot be excluded or limited under applicable law.
11. DBS Policy & Process
11.1 The company require all candidates to obtain an enhanced DBS check to work with both adults and children as part of our vetting process or provide an enhanced DBS for working with both adults and children which has been made portable and registered on-line.
11.2 Part of Fulbridge Social Care compliance is an enhanced DBS which will be checked within both the adult and child workforce. Once the candidate has completed the DBS form all documentation is checked and cross referenced before copies are taken by the HR department in accordance to the requirements set out on the front page of the DBS form.
11.3 If HR department have any concerns about the legality of any documentation provided, then we will inform the relevant bodies and look for guidance on the matter.
11.4 HR will undertake all checks on the completed DBS form and all information provided, they will forward the completed DBS form with required documentation to one of the companies counter signatures who will review all information provided before signing off the form, completeing DBS tracker and processing the individual DBS.
11.5 Please note that the company are not responsible for original documents which may go missing via the post – the company will return documents recorded delivery when a pre-paid envelope has been provided. If a pre-paid envelope has not been provided, items will be returned via un-recorded delivery.
11.6 All DBS certificates should be clean or in accordance to information provided on declaration form within original application pack. If information appears on a DBS certificate that has not been declared at application stage then this could result in your application being ended with immediate effect.
11.7 All company agency workers will be recommended to register their new enhanced DBS check on-line once they receive copy – this has to be done with fifteen days of receiving it (cost met by candidate)
11.8 A cost of £10 administration fee is charged for individuals who wish to use a portable DBS check to register with Fulbridge – this is non-refundable.
11.9 Fulbridge Social Care charge £60 to process an enhanced DBS per candidate (our provider charges £60 including administration fee – administration fee is non-refundable however candidates have a 14 day window from the day they have paid for their DBS to request a refund of £50 via email to hr@fulbridgesocialcare.co.uk however this is request is void if your DBS form has already been processed and sent to the DBS office for process.
11.10 DBS certificates are the property of the agency worker and not the company.
11.11 An enhanced DBS which is checked for both adult and children’s workforce can be purchased from another provider. Please note that external DBSs must be made portable.
11.12 Its the candidate’s responsibility to ensure all information provided on the DBS application form is correct, this includes current address, date of birth, and full name (s). If information is not completed correctly and an error shows on a returned DBS form, Fulbridge candidate services will not be liable for a replacement.
11.13 Fulbridge will process all paid enhanced DBS forms up to 90 days from the date of payment.
11.14 Certificates/Statements of good conducts MUST be obtained from any country other than the UK, that candidates have lived, worked or travelled for an extended period (12 consecutive months). In accordance to The Children’s Homes (England) Regulations 2015 .
Fulbridge Social Care believe international checks are an important part of compliance in making the decision on a agency workers application and suitability to work with Children and Young People.
11.15 In accordance to DBS process changes implemented on the 1st of August 2019 which outlines a withdrawals policy. As of the 1st August 2019, DBS will no longer be able to amend enhanced DBS applications where missing or incorrect information has been identified. This refers to addresses at which an applicant has resided within the last five years that haven’t been declared on the application and or a complete and detailed address history covering the last five years has not been provided.
From 1 August 2019, applications found to have missing address information as detailed above will be withdrawn by the DBS and a new application will need to be paid for and submitted. If an application is withdrawn for the above reasons, a refund will not be given.
Where such an omission is found, DBS will not contact the applicant, but will instead write to the Registered Body that submitted the enhanced application to inform them.
If a candidate completes a form and posts to the DBS department directly instead of sending to Millennium House, Dukesmead, Peterborough PE4 6ZN to be processed then the application will be withdrawn for the above reasons. If an application is withdrawn by the DBS, then Fulbridge Social Care will not refund any DBS application. If a candidate wishes to continue their employment application, they will have to pay and process another DBS form.
12. Data Protection Act 1998
12.1 The Fulbridge Social Care Website is operated by the Company. For the purposes of the Data Protection Act 1998, the Company is the “data controller” in respect of personal information that we obtain from you via the Fulbridge Social Care Website.
12.2 Where you have selected the option that enables the Company to share your CV, public profile and / or other Profile Information with a recruiter, that recruiter will also be a “data controller” for the purpose of the Data Protection Act 1998 and independently of the Company, owes responsibilities to you under that Act in connection with the processing of that information.
12.3 The website of the Information Commissioner’s Office provides information and assistance with regard to your rights under the Data Protection Act 1998 and related legislation (www.ico.gov.uk).
12.4 To the extent permitted by law and subject to clause 11.1 the Company and their respective staff accept no responsibility for any use which is made of the Materials and shall not be liable to any person for any direct or indirect loss or damage, including (without limitation) loss of profits, loss of revenue, loss of data or any third party claims which may arise from the use of the Materials.
12.5 All Fulbridge Social Care data protection policy and procedures are inline with GDPR policy 2018.
13. Online Training
13.1 The term ‘Fulbridge Social Care’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is Fulbridge Social Care, Millennium House, Dukesmead, Peterborough PE4 6ZN.

14. General
14.1 Notwithstanding that any terms may prove to be illegal or unenforceable, the remaining Terms and Conditions of this Agreement shall continue in full force and effect.
14.2 Except as expressly set out in these terms, nothing in these Terms and Conditions shall confer on any third party any benefit or the right to enforce any provisions of this Agreement.
14.3 The Terms and Conditions and Privacy Policy constitute the whole agreement between you and us relating to this subject matter and supersedes all prior arrangements or promises between you and us relating to this subject matter. Nothing in this clause shall limit or exclude any liability for fraud.
14.4 These Terms and Conditions shall be governed by and construed in accordance with English Law and you and the Company hereby submit to the non-exclusive jurisdiction of the English and Welsh Courts.
